Do I need to consult with an Elderlaw attorney before applying for Medicaid? Yes!! It is possible that, without realizing that you were doing it, you may have made gifts within the past five (5) years that will disqualify you from getting Medicaid. If you apply before the 5-year period expires, a penalty will apply, and during that time, Medicaid will not pay for your care. It is critically important to get advice from a knowledgeable and experienced Elderlaw attorney before taking that step.
