Question: Do I still need a will if I have a trust?
Answer: Always!!! If a trust is to distribute what you leave behind when you pass away, a will—known as a “pour-over” will—is necessary as a safety net: it will make sure that what you have not placed in your trust during your lifetime will get into the trust after you die. Keep in mind that whatever passes under your will goes to probate, so if that is what you are trying to avoid, you should consult with your estate planning attorney.
