Question – Who should I pick for my medical power of attorney?
Answer – First, it is critically important that you do pick someone. There needs to be a person named to make medical decisions for you if you are unable to communicate for medical reasons. That person is separate from the one in charge of your finances, although they may be one in the same. He or she must be dedicated to carrying out YOUR wishes, regardless of the demands of other family members, and should have a reasonable balance between emotions and practicality. It is vitally important that you make the identity of that person known to other family members now, so that there will be no power struggle if and when the need arises. Such a struggle is all too common when you fail to make that selection while you are healthy. This decision should be discussed with your estate planning attorney. – Jack N. Alpern, Esq.
