If I suddenly get sick and cannot communicate with medical personnel, who will decide how I will be treated? This is especially important today due to the pandemic. It is critically important that you have signed an Advanced Health Care Directive (either a Living Will or Durable Power of Attorney for Health Care) so that some responsible person is appointed by you, in advance, to be your spokesperson. If you do not appoint such a person before you become sick, it is possible that someone will have to go into the Probate Court and have a guardian appointed for you. This could add unnecessary delays and expense for your family. Please discuss this with a competent, experienced Estate Planning Attorney.
