If my spouse goes into a nursing home, are assets owned solely by me at risk? In Ohio, yes. Before a person may qualify for Medicaid to pay for their nursing home expenses, they must spend down their assets to a minimum level before Medicaid will take over payment of nursing home expenses. Medicaid does not care which spouse owns the asset; all but a few of those combined assets must first be utilized to pay the nursing home before Medicaid will take over. This is an extremely important matter which should be discussed with an experienced Elderlaw attorney.
