Who is responsible for payment of my bills when I pass away? If your estate goes through probate –which it does NOT have to do – that person is the one named in your last will and testament and known as your Executor or Personal Representative. If you choose to use a trust to settle your estate – thereby avoiding probate – that person is your Successor Trustee. That person must be thorough and trustworthy. Moreover, he or she must have the time to carry out those duties and responsibilities. Choose carefully.
